Terms of Use

The “Digital Script Archives” is a digital script archive service (which includes this Site; “the Service”) provided by the Consortium for the Promotion of Broadcast Script Archives in Japan (the “Consortium”). Users should read carefully and agree to these terms and conditions of use (the “Terms of Use”) before using the Service. By using the Service, users accept and agree to these Terms of Use.

Article 1. Application

  • 1. These Terms of Use apply to all users of the Service.
  • 2. Other rules and regulations concerning the Service, established separately from these Terms of Use, constitute part of these Terms of Use. In case there arises any inconsistency between the provisions of these Terms of Use and those of the separate rules and regulations, the latter shall prevail.

Article 2. Recommended environment

The Consortium recommends using one of the following browsers to enjoy enhanced security and usability of this Site. Users should have communications devices and software ready to use this Site on their responsibility and at their own expense. Communications and other charges for using the Service should be borne by users.

Article 3. Use of the Service

  • 1. To access digitalized scripts (“Digital Scripts”) on this Site, users need to provide necessary information to the Consortium as described below.
    • (1) For users who belong to a non-profit educational institution (“Educational Purpose Users”)
      • ・Name
      • ・The name of the educational institution
      • ・The type of institution
      • ・The method of use of the script
    • (2) For other users (“General Users”)
      • ・Student, writer, media person or others
      • ・Age
      • ・The purpose and method of use of the script
  • 2. Users may not use the Service, including Digital Scripts, for commercial purposes without the prior written consent of the Consortium.
  • 3. If an Educational Purpose User desires to use Digital Script data presented on this Site for educational purposes, the Educational Purpose User should send an email to the following address:

  • 4. Educational Purpose Users may not use the Digital Script data transmitted as provided in the preceding paragraph for non-educational purposes.

Article 4. Links to this Site

  • 1. Links to this Site may be made without permission unless such links are provided on a website which:
    • (1) actually or potentially contains any defamatory, slanderous or disparaging comments concerning this Site or a third party;
    • (2) actually or potentially infringes on the intellectual property rights, image rights, the right of privacy or other rights, or impairs reputation or interests, of this Site or a third party;
    • (3) runs afoul of laws, ordinances or rules and regulations, or offends against public decency; or
    • (4) actually or potentially interferes with the operation of this Site.
  • 2. The URL of this Site may be changed without prior notice.

Article 5. Intellectual Property Rights

  • 1. All copyrights and other intellectual property rights relating to the Digital Scripts presented on this Site remain vested in the right holders who have given the Consortium permission to use their rights.
  • 2. Any use of a Digital Script which is not for private use, educational or other purposes indicated in the exception provisions of the Copyright Act will infringe on its copyright. Such exceptional use requires permission from the right holder. Please contact the Consortium’s bureau by phone or e-mail for more information.

Article 6. Prohibited Acts

When using the Service, users may not engage in an act which:

  • (1) actually or potentially infringes on or undermines the rights, interests or property of the Consortium or a third party;
  • (2) is defamatory, slanderous or disparaging to the Consortium or a third party;
  • (3) prevents other users from using the Service;
  • (4) which actually or potentially obstructs the operation of the Service and causes disadvantages to the Consortium;
  • (5) provides false information to use the Service;
  • (6) uses or provides computer viruses or other harmful programs through or in relation to the Service;
  • (7) gains or attempts to gain unauthorized access to the network, systems, servers or other devices relating to this Site;
  • (8) actually or potentially runs afoul of laws and regulations or offends against public decency; or
  • (9) is deemed inappropriate by the Consortium other than the above acts.

Article 7. Suspension of the Service

  • 1. The Consortium may change the contents of the Service, or suspend, discontinue or terminate all or part of the Service at its discretion without prior notice to users.
  • 2. The Consortium will have no liability for any damage to users which may arise from measures taken by the Consortium under this Article.

Article 8. Use of Personal Information

The Consortium will handle personal information provided by users in accordance with the Handling of Personal Information, established separately by the Consortium, and these Terms of Use.

Article 9. Compensation for Damage

  • 1. The Consortium may seek compensation for damage (including attorney’s fees) from a user which is inflicted on the Consortium as a result of a breach of these Terms of Use or a wrongful or illegal act by the user.
  • 2. Any dispute which may arise in relation to the Service between a user and another user and/or a third party, or any damage inflicted by a user on another user and/or a third party, should be resolved on the involved users’ responsibility and at their expense. The Consortium will have no liability for any such dispute or damage.

Article 10. Modification of These Terms of Use

  • 1. The Consortium may modify these Terms of Use. Users should make sure to refer to the latest version of these Terms of Use.
  • 2. Any modification of these Terms of Use will take effect when the modified version of these Terms of Use is posted on the Site. By using the Service after the modified version of these Terms of Use is posted, users agree to the modification of these Terms of Use.

Article 11. Governing Law and Jurisdiction

These Terms of Use are governed by the laws of Japan. All disputes arising from or relating to these Terms of Use will be exclusively brought in the Tokyo District Court.
